Official Promotional Rules

1. DESCRIPTION: NO PURCHASE NECESSARY TO ENTER OR WIN. The “DDR COMMUNITY LAUCH SOUNDTRACK CD SAMPLER GIVEAWAY” ("Promotion") begins on February 25, 2008 at 12:01 PM PST (“Start Date”) and ends on March 25, 2008 at 11:59 PM PST ("Promotion Period"). The first 1000 people to register on the DDR Community Site www.konami.com/ddr (“Site”) will be eligible to receive a DDR Soundtrack CD Sampler (“Gift”).  The administrator of this Promotion is Konami Digital Entertainment, Inc., Online Division ("Administrator").The Sponsor of this Promotion is Konami Digital Entertainment, Inc. ("Sponsor").

2. HOW TO ENTER: Visit the Site during the Promotion Period by logging on to  www.konami.com/ddr  Follow the on-screen instructions and complete the entry form by providing all of the information requested.  Once the form is completed, Entrant must click the "Submit" button to receive one (1) entry into the Promotion. All entries must be received by 11:59 PM PST on March 25, 2008.  Entrants may only register once during the Promotion. Entrants must provide all information requested to be eligible to receive a Gift. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by Entrants becomes the property of Promotion Entities.  Entries generated by a script, macro or other automated means will be disqualified. Each Entrant must be the rightful owner or have authorized use of the e-mail address identified in the entrant's entry as of February 25, 2008. In the event of a dispute as to the identity of an Entrant, the Entrant will be deemed to be the person in whose name the e-mail account governing the e-mail address was opened.

3.  ELIGIBILITY: Promotion is open to legal residents of the 50 United States and Washington, D.C. who are at least 14 years of age at time of entry.  Eligible Entrants who are under the legal age of minority in their state of residence (“Minor”) should get their parent or legal guardian’s permission to enter.  A minor Entrant will be required to prove parental consent in the form of an Affidavit of Liability before he or she can be declared a winner and any prize can be awarded.  Entrant must have internet access as of February 25, 2008.   Any individuals (including but not limited to employees, consultants, independent contractors and interns) who have, within six months prior to February 25, 2008, held employment with or performed services for Sponsor and Administrator, (collectively, "Promotion Entities") or any organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Promotion are not eligible to enter or win. Immediate family and household members of such individuals are also not eligible to enter or win. "Household Members" shall mean those people who share the same residence at least three months a year. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. Void where prohibited.

4. WINNER SELECTION AND NOTIFICATION:  The first 1000 Entrants shall be eligible to receive a Gift as determined by the Administrator on or about March 25, 2008.  Gift winners (or his or her parent or legal guardian if such potential winner is a Minor) will be notified by telephone, email and/or overnight mail within twenty four hours of Administrator’s selection.  Selected winners will be required to respond (as directed) to the notification within 72 hours of attempted notification. The failure to respond timely to the notification may result in forfeiture of the Gift and, in such case, Sponsor may select randomly an alternate winner from among the remaining eligible entries.  

5.  GIFTS: 1000 Soundtrack CD Samplers.  ARV: $1. Total value of the Promotion is $1000.00.  Gift winners cannot assign or transfer the Gift to another person. No Gift substitution is allowed except at the discretion of Sponsor. Winners will be responsible for any and all federal, state and/or local taxes resulting from acceptance of the prize.   If Gift is awarded but unclaimed/forfeited by recipient, Gift may not be re-awarded, in Sponsor's sole discretion. If a Gift cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value may be awarded.  Other restrictions may apply. Limit one Gift per person, per household.

6.  ODDS OF WINNING:  Odds of winning depend on the number of eligible entries received.

7. CONDITIONS OF PARTICIPATION/RELEASES: By participating, Entrants agree to be bound by these official rules and the decisions of the Sponsor and the Promotion Administrator, which shall be final in all respects. Promotion is void where prohibited or restricted by law. All federal, state and local laws and regulations apply. By participating in this Promotion and/or by accepting any Gift that they may win, Entrants agree to release the Sponsor and  Administrator; their parent, subsidiary and affiliated companies, units and divisions and advertising and promotional agencies and Gift suppliers; each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Promotion and/or acceptance or use of the prize. Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor's sole discretion, without further obligation or compensation. The Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, postage-due, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the Gift or resulting from acceptance, possession or use of a Gift, or from participation in the Promotion; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Promotion. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Promotion, and reserve the right, in their sole discretion, to cancel, modify or suspend the Promotion should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor's control, corrupt the administration, security or proper play of the Promotion. Sponsor may prohibit you from participating in the Promotion or winning a Gift if, in their sole discretion, they determine you are attempting to undermine the legitimate operation of the Promotion by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other players or Sponsor representatives. This Promotion will be governed by the internal laws of the State of California. Any and all legal actions or claims arising in connection with this Promotion must be brought in a court of competent jurisdiction within California and you hereby submit to jurisdiction in California. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE PROMOTION. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

PRIVACY POLICY: Any personal information supplied by you to Konami Digital Entertainment will be subject to Konami's privacy policy posted at http://www.konami.com/edealinv/servlet/ExecMacro?nurl=control/Privacy.vm&ctl_nbr=3810. By entering the Promotion, you grant Konami Digital Entertainment, Inc. permission to share your email address and any other personally identifiable information with the corresponding Promotion Entities, and personal information supplied will be subject to Promotion Entities respective privacy policies.
